Regulations

The laws of reference for maintenance

Every new plant must comply with regulations and pass technical and administrative inspections. There are two main figures involved:

  • Theinstaller, responsible for the design, construction, installation, and marketing of the elevator.
  • The building owner (or his or her legal delegate) who signs the maintenance contract.
Essential steps include:
1. Acquire the declaration of conformity provided by the installer.
2. Designate arecognized certifying entity or the relevant ASL for periodic safety inspections.
3. Sign a maintenance contract with a specialized company that employs qualified personnel.

Once these obligations have been fulfilled, theactivation of the system can be notified to the relevant municipality or province within 60 days of receiving the declaration of conformity from the installer.

Legal obligations: decrees and UNI standards of reference

The laws we will cite involve all phases of an elevator's life, from construction to installation to operation and maintenance of the system.

The first legal reference is Presidential Decree No. 162 of April 30, 1999, "Regulation containing the rules for the implementation of Directive 95/16/EC on elevators and simplification of the procedures for the granting of the authorization for elevators and hoists, as well as the relevant operating license." This legislative reference was subsequently amended and supplemented by several other decrees, most recently Presidential Decree No. 23 of January 10, 2017, "Regulation concerning amendments to Presidential Decree No. 162 of April 30, 1999, for the implementation of Directive 2014/33/EU on elevators and safety components of elevators as well as for the operation of elevators.": the regulation explicitly refers to European Directive 2014/33/EU on elevators, which superseded the previous 95/16/EC. Presidential Decree No. 162, April 30, 1999, as amended, is divided into Chapter I and II, which contain a total of 21 articles and 12 annexes: Chapter I provides some important definitions such as those of elevator and freight elevator, indicates the essential safety and health protection requirements, makes explicit the procedures for assessing the conformity of the elevator with the relevant European directive, the CE marking that every elevator must clearly and visibly display in the car, market control and safeguard clause, and indicates the authorized certification bodies and the procedures related to certification. Chapter I refers to all elevators installed after June 30, 1999, the effective date of Presidential Decree 162/99: all elevators built before this date, on the other hand, respond to the regulations in force at the time of installation and related testing.   • Chapter II refers to elevators and elevators in private service and defines the commissioning of new elevators, periodic inspections, extraordinary inspections and maintenance of systems installed in the national territory. In addition, it makes explicit the necessary presence of the installation booklet, the availability of which must always be guaranteed by the owner or his legal representative. Finally, it also clearly indicates prohibitions of use.

Ministerial Decree 37/2008 provides for the "reorganization of the provisions on the installation activities of systems inside buildings," which include elevators, freight elevators, escalators and similar systems, defined as "systems for lifting people or things."
The Decree:

  • defines routine maintenance as interventions to contain degradation due to the use of the installation and to respond to accidental events that do not change the structure of the installation or its intended use, and specifically refers to Presidential Decree 162/99, as amended, for the maintenance of elevators and elevators in private service
  • indicates that companies qualified for the activities included in the Decree must be registered in the business register or the provincial register of artisan companies, the procedures for companies wishing to carry out activities related to the facilities listed in the Decree, and the technical and professional requirements for those working in the sector
  • Defines the obligations of the developer or owner in the case of entrusting work on installation, conversion, extension and extraordinary maintenance of facilities
  • is the legislative reference that applies when modifications are made to existing facilities.

The technical provisions to be applied in the case of works to modify, modernize and improve the safety of existing elevators are contained in the standards of the UNI 10411 "family," which include the most frequent modifications to elevators and list the requirements to be followed in order to ensure an acceptable level of safety, and in any case higher or at least equal to that which the installation possessed before the modification.
The UNI 10411 family standards applicable to modifications of existing elevators are as follows:

  • UNI 10411-1: 2014 - Modifications to electric elevators that do not comply with Directive 95/16/EC.
  • UNI 10411-2: 2014 - Modifications to hydraulic elevators that do not comply with Directive 95/16/EC.
  • UNI 10411-3: 2016 - Changes to electric elevators installed in accordance with Directive 95/16/EC and UNI EN 81-1
  • UNI 10411-4:2016 - Modifications to hydraulic elevators installed in accordance with Directive 95/16/EC and UNI EN 81-2.
  • UNI 10411-5: 2017 - Modifications to electric elevators installed in accordance with Directive 95/16/EC or Directive 2014/33/EU and not in accordance with UNI EN 81-1.
  • UNI 10411-6:2017 - Modifications to hydraulic elevators installed in accordance with Directive 95/16/EC or Directive 2014/33/EU and not in accordance with UNI EN 81-2.
